Home birth may result in a malpractice suit

A mother was concerned about her unborn babies condition when she fell so she went to the hospital. Doctors told her she was fine and sent her home. Her baby was born the next morning at home at 23 weeks and suffered severe brain injury from lack of oxygen. The parents took their case to court to try to have their child placed in a state program so he can receive lifetime medical care but their claim was rejected on the basis that the child was born at home and not in a hospital. The parents are now left only with the option of perhaps suing the doctors and the hospital for medical malpractice.
