A mother received $8,269.50 compensation after her baby was born with brain damage and died 5 months later. The mother alleges that the doctors were negligent in not ordering a cesarean sooner. After a 16 hour labour, the mother’s uterus ruptured causing permanent brain damage to the baby. The mother had to undergo a hysterectomy after the delivery. Doctor’s retaliated by arguing that the woman suffered a rare complication that occurs in 1 in 27,000 deliveries and the doctors actions saved her life. The infant’s death was compensated by the Birth Related Neurological Compensation Act but the mother’s lawyers plan to sue for emotional distress and loss of her child. The compensation she had received simply covered funeral expenses and medical expanses for the duration of the infant’s life.
