Cerebral palsy is a common area of medical malpractice lawsuits. In one study of birth injury medical malpractice lawsuits, 64% of claimants had children with either cerebral palsy or Erb's palsy (Suing for Medical Malpractice, Sloan et al, 1993). Cerebral palsy is a serious and usually permanent brain injury that often arises during childbirth when the fetus does not receive enough oxygen during delivery.
