A woman won a medical malpractice suit after six years and was awarded $118,000 of which half will be used up by legal fees and costs. The doctor and medical center allegedly involved in a baby's death from oxygen loss at birth both claim they should be protected from law suits of this nature because of the state's birth-injury program which disallows law suits but pays lifetime medical benefits for the affected child. The baby died because his umbilical cord was wrapped around his neck, starving him of oxygen. He was revived twice after birth but eventually died. His mother claims that doctors should have noticed the baby's deteriorating condition and acted sooner.
