A couple successfully sued a hospital and obstetrician for providing negligent care of the surrogate mother who gave birth to their son who has cerebral palsy. The parents and jury believed that the child would not have sustained brain damage and permanent visual loss if the doctor and nurses in attendance had read recorded fetal monitoring information adequately. The cardiotocogram (fetal monitor strips) indicated that the baby was in distress, however the doctor did not consider a caesarean section, although the jury was informed that the baby would have received oxygen earlier, perhaps avoiding brain damage. The obstetrician was judged by a local magazine to be the best doctor in the state last year.
